NATCHEZ — At his hearing Monday, M.L “Binkey” Vines was removed from his post as circuit clerk by Judge Joe Webster.
In addition, Vines received a one-year suspended sentence and one year of supervised probation.
“We are very disappointed with the ruling,” said Claude “Buck” Pintard, Vines’ attorney.
Pintard said he felt that evidence produced by the attorney general’s office did not prove that Vines intentionally withheld financial records from his office.
The missing records in question were Vines’ criminal, civil and garnishment journals from 2006.
And in a new development, it was learned during the hearing that Vines had turned in his records just last Friday.
Those same records were requested by the county’s contracted auditor Switzer, Hopkins and Mange 11 months ago.
Susan Mange testified that the lack of Vines’ records, until Friday, caused the auditor to issue a limited opinion on the county’s finances.
Mange also testified that her office made numerous attempts to contact Vines and his office in order to get his records.
Mange said her office called and wrote letters to Vines’ office all in an effort to get Vines’ records.
Vines’ attorneys also tried to show that Vines may have never actually seen a letter requesting his records from Switzer, Hopkins and Mange from December of 2007.
Mange said the letter was hand delivered to Vines’ office, but Pintard said if the letter was left on Vines’ desk it could be possible he was never aware of it.
In fact, much of the argument presented by Vines’ lawyers attempted to show that Vines was simply unaware that Switzer Hopkins and Mange needed his records at all.
To counter the argument, state’s attorney Brandon Ogburn called President of the Adams County Board of Supervisors, Darryl Grennell to testify.
Grennell said in his testimony that on May 21, 2007, Vines was called before the Adams County Board of Supervisors and told that the auditing firm needed his records to complete the Adams County audit.
Vines at that time, Grennell said, told the board he would comply with their request.
However Vines’ records were not received until Nov. 9.
And the board, Grennell said, has still never seen any of Vines’ records.
Webster said his original order that said Vines must comply with all requests of the state auditor’s office did not leave much room for error.
Webster said he was surprised by Vines’ reluctance to cooperate with auditor’s office when he said he thought Vines would have “jumped through hoops to get this done.”
On Sept. 26, 2006, Vines was indicted on 13 counts of embezzlement and pleaded guilty to three counts on May 4, 2007.
However Webster, an out-of-town judge appointed to the case withheld the acceptance of Vines’ plea and instead placed him on probation.
On Nov. 1, Attorney General Jim Hood’s office asked that Vines be sentenced for his failure to comply with requests of the state auditor’s.
“We appreciate the attorney general’s office moving on this issue,” S. Ross Aldridge, a spokesman with the auditor’s office, said.
Aldridge also said that the auditor’s office has received $72,847.17 in restitution from Vines’ bond company.

I totally agree. This is one sorry judge! He needs to take the sentence of jail time for Binkey! How dare this judge assault our intelligence this way. I wish this judge would do something in violation of the law, be arrested, and come before a very harsh judge. I am one who is outraged at this sentence. The system should now look at others with the same jaundiced eye. Why even have a court system if this is the way it is to handle business.
Does this mean Eddie Walker will start immediately, or will he have to wait until January?

Suspended????? I thought that if a person VIOLATED THE TERMS OF THEIR ORIGINAL SENTENCE THEY WOULD HAVE TO DO THE TIME. GEEZ!!!!!

OKAY, this is just what I expected. He paid back the money and it was his first offense.
Now, just wait for the latest records to be audited. Vines will have a prior conviction if things are not in order and God help his happy, fat (expletive)!

I am not surprised, but very disappointed in the decision. I really thought the idiot judge would give Binkey several years and suspend it.I never imagined ONE year. What a joke.I do hope the Judicial System will NOT appoint Joe Webster to hear another case.What a sad day for the citizens of Adams County.We DO deserve much better.

I am really disappointed in the legal system. I knew Binky when he ran the first time and wondered then about how honest he was. Time has proved me right and he will be out to maybe be dishonest to someone else.

Ok this will be hard for most to undertand but what Binky did and what Harris did are 2 very different things. I am not defending Binky at all, he should have some jail time to spend. But you really need to read more into what Binky is being charged with. In a nut shell - Harris was pure and simply pocketing tax payer money, Binky was mixing his personal money and the county's money and didn't keep the records to show what had happened. What Binky did was just plain stupid, and if he would of just come clean from the beginning he would of probably not gone to court.
The judicial system actual did work here, everyone was just expecting Binky to get a sentence like Harris did. But the truth is they were charged with 2 different things.

I can't say what I'd like to say because it would get ZAPPED. I was there. Binkey had such a smile on his face entering the courtroom. The majority felt as I did. Justice was not served and Adams county was slapped in the face again. Please, Brother2Brother, believe me when I say, this is not about color. This is a judicial system gone sour. It isn't who you are or what you've done, It's who you know and how much can they afford. Money talks in Adams county. Binkey will be thanking God and praising Him for bringing him through this. This, I don't feel, was the hand of God. Binkey broke many commandments, God isn't happy, and He don't like ugly. There were many people that owed Binkey favors and he called them all in. Binkeys' attorney and Judge Webster are just some of the "good ol boys."

I agree with you brod, this has nothing to do with color; it is all about who has the most money to help line their pockets, and what dirty favors Binkey has helped those "donors" with in the past. Binkey is far too smug and hypocritical to ever not show up smiling. He knew before he ever walked in the court room he would not serve a day in jail.
And to think the "intelligent" people of Mississippi put the same AG back into office for 4 more years. This all began we he hand picked this ignorant judge to over see Binkey's case to begin with. They got exactly what they set out to do...Let one of their own off without doing the time.

I think this is disgusting!!! I can't believe that he got slapped on the wrist - AGAIN. What in the world will it take for these judges to actually sentence someone accordingly in this town? What he did may not have been as bad as the Wilkinson or Jefferson County Circuit Clerks, but come on. Since some are already playing the race card, my question would be, "Wasn't the majority of the black population the ones that voted for him in the first place?" You can't have your cake and eat it, too. He's a crook, no matter what color he is and he deserves to be punished! He ADMITTED his guilt in a court of law. Not only that, but he then spit in their faces when he didn't turn in those reports as requested. And what does he get for all of this? Nothing. I agree that someone needs to do a very thorough investigation here. I have a feeling this is MUCH worse than it appears.

Hood did wrong by not having this thing investigated more thoroughly. What are the odds that three adjoining counties all had their circuit clerks arrested at the same time? Wouldn't a red flag go up? I would be checking some things out. And as far as the missing reports go, he should still be investigated for that and new charges filed, if necessary. I don't care how much money his "backer" has, it's not right. They should be checking into that "backer", too.

Eagles - Hood could of probably investigated this alot more, but the end result would of probably been the same thing. He had enough evidnece to convict Binky and did. I agree with what you are saying, just not sure why you are going after the one person that did what he was supposed to.

I'd like to address what brother2brother wrote. First, I am white. I don't like it when people pull that race issue stuff, but I can certainly see why you think that way. Regardless of color, all three of these men broke the law. The charges may have been different, but they all deserved to be punished. One year of probation is NOT punishment, it's a joke. People like this Judge Webster are the very ones that make our judicial system a joke. I am embarrassed that a judge in this state could be so stupid. I will tell you, I DO NOT agree with what Vines did, or with the punishment he receieved for it. I refuse to side with someone or support them 'just because they are white'.

No mike, I blame the judge for this. Hood was not completely without blame, but the judge should be ashamed of himself. I would feel better even if they gave him two weeks in jail. That still doesn't justify what he did, but at least he would have that time to really reflect on things. I'm sorry if my comments offend those of you that support Vines. I just can't believe our courts are so lenient.

I'm going out on a limb with this next comment. It isn't over. It is, as far as Judge Webster is concerned. Today's hearing just got him out of the way. Let him slither his way back into retirement and go into hibernation. Binkey and his team can go home today, have a beer and wait for the steaks to get put on the grill. Celebrate this victory, but, it isn't over. There was no justice served today. People just wait a few days or weeks. This is not finished.

Brod, you just might be right, but I feel like Jefferson County was mislead. To put a car saleman in office(Circuit Clerk) and guess what? He is selling car right out of the office. Mr. Harris did not get a fair trial and I will forever stand on that. The FED and along with some of the jealous citzens help to put Mr. Harris out of that office. And you would not beleive the same citizens that was aganist Mr. Harris, sell drugs, got Phen-Fen monies, lied about being in the Family Dollar Store when it collapsed, these are the same citzens that made bogue ballots in the primary election to make sure Mr. Harris lost and some of their candiates would get in office. It is evidence that these jealous hearted citzens made this happen. And the newly elected circuit clerk was a part of it. Jefferson County is being ran by the Phen-Fen stich. I can't say what I would like to say, but I can give you a 3 week paper of the jealous hearted and evil people in Jefferson County. As long as you are doing what they want you to do, than you are alright, but not ever stand up to them and disagree. That is when the problem being.

I am ashamed that this man was in charge of anything in this county. It's bad enough that he was guilty of stealing the money, but even worse that he didn't even get punished. When he pled guilty, they should have snatched his butt out right then. Instead, they gave him many more months to take anything else he wanted.

yes.... you are right.... but at times research, doesn't turn up anything. During election times there are so many things being thrown around (negatives from the competition)that you don't even know what to believe or not believe. Also, alot of times the job itself, brings out the corruptness in an individual. I can gaurantee you one thing.... He was NOT alone in his mis-doings. Brother2Brother, I am so sorry that you are in the midst of so much corruption. I'd say move to Adams county, but, believe me the grass is no greener. We the people, black, white, tall, short, fat or thin. We have the power to make a difference. We must get smarter about how we bestow our votes. We can't vote for a person because they may be a friend, or black or white, or because they're a friend of a friend. Even if we vote for someone that we think is the better of two evils, our vote is wasted. Our ability to vote is a gift. Brod,and brother2brother i have completed 51/2 miles on treadmill and have calmed down. i called jim hood's office at least 20 times with important inside inormation..he did not return one call too busy getting his hair weave in place for commercials..edwin edwards pursed me, i am a new orleans native. i told him i do not go out with people who will end up in prison / he was too old for me as well, he called and called, he stated prison is on place he would NEVER BE YA'LL KNOW THE REST!!!

I still fee that binky meant well with the money that is not accounted for, however he is still to be held accountable for his actions. I've heard a great deal of anger in the past posts and would like to leave you all with these words. Life is not fair. People with money and connections will always be dealt a better hand in life. Harris of Jefferson County got six years for this!!! VINES, free to walk the streets of Natchez. At least he can walk past his office and say "I used to work there. What can Burnell Harris do? Nothing. Just sit behind a jail cell wall and cut his fingernails with this teeth. Come on Adams County!!! Are you serious? And we wonder why Natchez is becoming a retirement town and falling off the face of the maps. We wonder why our yound people leave away from home so quick. Any time you mix money from your place of employment in with your own money...unless it's your paycheck...it is stealing, plain and simple. However, if the binkster made some accounting errors in addition and subtraction, that would be another story.
I'm not exactly sure how things are done in the clerks office, as far as taking in money goes, but surely someone could come up with a way to keep this from happening again in the future. A good computer program maybe? Or perhaps, accept no cash? But then, a computer printed receipt given to each person who does any business with the clerks office should be able to tally up all money taken in at the end of each day, and also, generate a report at the end of each month.

He is somewhere celebrating and poor Mr. Harris has to think about how hard its going to be to say good bye to his family.Not saying that he should not be punished. And to say that Binky is just a bad bookkeeper is ridiculous. There is no way he just mistakenly mixed his own personal money with the tax payers money, if yall believe that well you know how the rest of the saying goes. I like Mr. Vines but I still don't think that Mr. Harris sentence was fair.

By not accepting Binky's guilty plea, the Judge allowed him to stay in office, run for reelection, and have a year subject to good behavior. Now he accepts the plea, removes him from office 2 months before he is scheduled to be removed by the voters, and sentences him to a 1 year suspended jail sentence and a year of probation. Both times Binky was before this Judge the plea was guilty. Both times the Judge said no jail time. The real difference between the two hearings was the first one allowed him to run for reelection which had to be the goal of the Judge setting aside the guilty plea. Now that my friends speaks volumes for the political clout (money) that this man has had backing him. In this case Justice was not only blind, but deaf. She did not hear the citizens crying out for honesty in the courtroom!

Hood picked Webster because he could control him. He told him to go light on Binky. You see Hood has some serious "Man-Love" for M.L. Vines. When the election got near he ordered Webster to sentence Binky just to get more votes from Adams County. The fix was in, Binky would get only probation.

It was a smart move to plead guilty, that way he avoided a jury trial. If you can afford a good lawyer and a good tax accountant you can work the system every time. I just hope the tax man gets his share but I doubt Binkey claimed all he stole on his income tax form. Do they have a line to list income from embezzlement?

If you want to place blame, you need to blame the citizens of Natchez. Some of you were making comments about evil being everywhere. Evil is not everywhere. We as a society just over look the little things that people do and it grows into evil. This why most of the white people didn't vote for Binkey. They new a lot of the little things. I have daughters and I tell them all the time that when in relationships whether it is a friend, professional or romantic; you always need to look at the actions and not what they are telling you. If your friend is telling you that they are your friend but are constantly being ugly to you, they are not your friend. Same goes with politics. People need to pay attention to the character of a person. If you see them doing little things corrupt, then they will do large things corrupt. Binkey was sending signals from the get go and a large percentage of our population failed to see it. Open your eyes and starting holding people to higher standards.

mucasplugg, as much as you want to believe otherwise, Hood could not have picked the judge. It just doesn't work that way. You can't pick your own judge. Also, it doesn't make sense that Hood has "man-love" for Binky. If he did he would not have moved for him to be sentenced. He, nor anyone else can tell a judge what to do. Hood indicted him with embezelment of $228,000. When it could finally be proven that he had not complied with the judges orders, he motioned for him to be sentenced.
Oh yeah, Webster is the same judge that let off the mayor of Jackson, too.
This judge needs to go! Aren't there sentencing guidelines that a judge is supposed to use? This is a travesty. And Binky is trying to say he didn't know they were requesting the records? Hellooo? Even if he didn't get all the letters or messages from phone calls, doesn't he read the paper? I knew they were reqesting his records so why didn't he.

Brothertobrother...you made a post yesterday afternoon and I am surprised that all of these fine posters have not said one word about it. You knocked someone in local politics as being a fenphen snitch. Until there is no stigma attached to people who "snitch" on law breakers and cheaters, we can continue to get officials who have their hands in the till. Do you think no one knew what Binkey was doing all these years. They knew that our society would look down on them if the wrong doers got into trouble, so they kept their mouths shut! Why would someone steal oil from anyone else? The one that owns/leases the well is the one on the gold mine. No, Alton Ogden is not Chris' dad. Although, his son has the same name (Alton) and runs an oil company here in town. I can't really see this new "backer" teaming up with either of those Alton's - or letting someone get away with stealing oil from him. I'm not sure about that story.

I was referring to a post by brother2brother on November 12th, however I've been informed that he was not referring to Mr. Vines as a car salesman. If this is true, I am sorry for the misleading information. Therefore I don't know who he was referring to but the post follows:

Brod, you just might be right, but I feel like Jefferson County was mislead. To put a car saleman in office(Circuit Clerk) and guess what? He is selling car right out of the office. Mr. Harris did not get a fair trial and I will forever stand on that. The FED and along with some of the jealous citzens help to put Mr. Harris out of that office. And you would not beleive the same citizens that was aganist Mr. Harris, sell drugs, got Phen-Fen monies, lied about being in the Family Dollar Store when it collapsed, these are the same citzens that made bogue ballots in the primary election to make sure Mr. Harris lost and some of their candiates would get in office. It is evidence that these jealous hearted citzens made this happen. And the newly elected circuit clerk was a part of it. Jefferson County is being ran by the Phen-Fen stich. I can't say what I would like to say, but I can give you a 3 week paper of the jealous hearted and evil people in Jefferson County. As long as you are doing what they want you to do, than you are alright, but not ever stand up to them and disagree. That is when the problem being.

Acomment I made was removed from the site, however what I said was true, I have court documents, affidavits, and video footage of the event, oil people lined up with Binkey, prior to him getting caught....signing out fo good on this matter,,,,,

Everyone needs to goto clarionledger.com and look under the editorial heading at the story about Binky---and the "judge" who sentenced him---or the lack of a sentence.

Taledatruth, you need to go back and read these posts again. Classylady didn't say anything about Arnell Harried selling from behind his desk. She was only commenting on what Brother2Brother said. He is the one who first mentioned about someone selling cars. He is the one who you need to ask.

If you know Buck as I do you know he is one of the meanest old men in Natchez......thankfully I only run into him once in a blue moon. mean man!!
