Monroe judge to hear Lipsey’s election contest

VIDALIA — The Louisiana State Supreme Court has appointed a judge to hear the election contest filed by sheriff candidate Glenn Lipsey.

The contest will go before the seventh district judicial court at 10 a.m. Friday, but because both Judges Kathy Johnson and Leo Boothe recused themselves from the case the court had to appoint a judge pro temp for the hearing.

Lipsey lost the Oct. 20 primary election to incumbent Sheriff Randy Maxwell by 21 votes.

Judge John Harrison, of Monroe, will hear the contest.

Concordia Parish Clerk of Court Clyde Ray Webber said he has never seen an election contest of this nature before.

In the official civil suit filed to contest the election, the Lipsey campaign listed the names of almost 100 voters whose votes they wanted to contest.

“We have had a few contests concerning whether or not someone lived in the district they were running for before, but we’ve never had anything like this,” he said.

Webber said he has no way to predict what direction the judge might take during the hearing.

“The judge has several options available to him, and it’s completely up to him which way he goes,” Webber said.

According to state statute, if the trial judge finds a vote to be fraudulent, the judge may subtract that vote from the total number of votes cast for a candidate.

Likewise, if the judge finds that legal votes were excluded from the final count, those votes can be added to the final count.

Lipsey is contesting the election on the grounds that some persons who voted were not qualified to do so in the parish or the precinct in which they cast their vote.

“We have solid evidence that some people who voted have homestead exemption in another parish or another state,” Lipsey’s attorney Andy Magoun said. “With some others, it’s a toss-up as to where they say they spend their days.”

Some voters also may appear on the voting register for both Concordia Parish and Adams County, Magoun said.

The Lipsey team will try to find out if those voters are voting on both sides of the river or if they have legitimately moved to the parish and their names were left on the county rolls as an oversight, he said.

Since filing the necessary civil suit listing the names of voters whose votes are being contested, some names have been removed after voters contacted the campaign, Magoun said.

“Obviously we were in a time jam to sort through all of who voted and check that they are residents of Concordia Parish,” Magoun said. “If someone calls us with a legitimate complaint about being included in the list (of votes contested), we will certainly accommodate them and remove them.”

Other allegations Lipsey’s campaign has leveled are of vote buying, voting by convicted felons, improper prisoner transport for voting and assistance in voting provided to those who did not qualify for it under the law.

“We are not alleging the people who may have voted with assistance contrary to the law committed voter fraud,” Magoun said. “We are contesting the procedure in which they voted. That is incumbent on the registrar of voter’s office and the (election) commissioners on the site.”

The Lipsey suit also alleges some qualified voters were turned away at the polls.

“We have requested the court count the Lipsey votes and declare him the winner,” Magoun said. “But that’s not a likely scenario.”

The court can also throw the election out and order a new election or it can throw the contest out, Magoun said.

The outcome of the suit can be appealed to a higher court.

“I would think both sides would exhaust the appeal process, however it turns out,” Magoun said.

I hope MamaC contacted them to remove her name. She seemed so genuinely concerned about her name being on the list. Said that she knew for sure that some of the votes were legit. We will have to wait and see what the judge does.

Hopefully not long! And we can finally get the better man in there,Maxwell should"nt have done all of this lying,and letting people vote that were"nt suspose to.To me that shows he was afraid of Glenn,and he knew Glenn would be our next sheriff,and the only way he knew what to do,is buy votes,get out of towners,and prison inmates,that are"nt suspose to vote.To me thats a sore loser! I always thought that once convicted of a felony one l;oses all rights to vote unless they recieve a pardon.
And if you are serving time for a misdemeanor I didn't think you could vote while serving time

Pre-trial inmates are allowed to vote by mail in. They are incarcerated and can't vote at the polls, in which election day some did. Felons can not vote.

familyofGod i think the same thing. There is no reason for this to get ugly I know that everyone has their own opinion but they don't have to be so ugly or they will shut the comments down again. I hope that all of this will be over soon so that the people of Concordia Parish can get on with their lives and not have to worry about this anymore. Felons cannot vote unless they have received a pardon for voting purposes. People convicted of misdemeanors can vote even if they are serving time. However, they can only vote in the parish of their residence; the jail that the parish is in is not their residence. My understanding is that they do not go to the polls to vote but must do so by absentee or as we call it now, "early voting". Not sure if the vote must be by mail or if they are taken to the registrars office. One thing is clear, the sheriff does not get to make the decision. If an inmate voted illegally, it's the registrar of voters fault and if the inmate voted at the polls, it's the voting commissioner's fault.
I don't blame Lipsey for challenging but it makes me angry that he considers everyone on his list a crook. Are nursing home residents crooked because they voted? Are people who are temporarily out of the parish due to school or employment crooks even though they are not registered anywhere else? Do you honestly believe that everytime someone moves in or out of the parish and votes that the sheriff is aware of that fact. The Lipsey group thinks if you are not for them then you have no rights and are crooks. When our troops come home from Iraq and other foreign nations, will the Lipsey group have signs telling them how to vote or face the wrath of their hate group? Remember that some people who voted for Randy did not do so because they did not like Glenn. Friends vote for friends in many cases. This is true on both sides of the fence. Glenn is going to make sure that some people will never support him because of the attitude that he and his followers exhibit toward the Maxwell side of the fence.

Okay, what I get out of that is that, 1)What kind of assistance did they have? and 2)Who was pushing the buttoms for the ones that needed assistance? If you have an older person voting that needs assistance, that doesn't know how the machine works and someone is pushing the buttons for them, how do they know who they chose was actually voted for?

i can honestly say, in the lipsey camp as its called, there were several voters (on his side of the fence) who were not on the list that should have been. Why werent they on the list. The RM camp has the names, why didnt GL have them?
gladtobegone, i would only hope that if i needed assistance, the person i take into vote with me, I could trust and there would be no questions asked. It happened more than the list says, but like i said, these arent being questioned, why? What is the correct procedure? If i need assistance, is that information on my voter registration card, or is up to the commissioner in charge to make that call. just want to know

why didnt they get to vote, did they have their proper id with them. Ive heard that a lot of names have came off that list. did some of the watchers make mistakes (surly not). if i have my id, im on the list of voters, i can vote. If im not on the list, its my fault for not reporting the correct information to the registrar of voters office. people who voted twice, how did that happen. did the commissioner in charge not do her job. How does it happen?

I'd wonder that, too bbm. I have to go through an act of congress to vote over here. You don't just walk in, say "My name is....." and they let you vote. I've never voted in Louisiana, though. I would think it is the same everywhere. If not, what's to keep this sort of thing from happening everywhere? Besides, IF someone who was working the polls was doing any candidate a "favor" and letting things slide, all they have to do is say it was an honest mistake and all is forgiven. These people volunteer to do this. It's not like they are paid. What do you do? You be firm on the procedures and process and you look into it when someone has such allegations. After all, that's what this is - allegations. I don't think he means any harm in contesting, but I would want to know if people were allowing someone to vote who doesn't have the right to.

Back to the topic of "Court Appoints Judge", each voter in both "camps" should appreciate an unbiased judge being brought in to hear this complex case. Thank you Judge Boothe and Judge Johnson. I ask that you keep to the topic and let the legal system do its work!

We have a right to know these things as citizens. I don't live in Concordia, so I don't have a say in this matter, but if this were happening in Adams county, I'd want to know. It's not because one is a crook or not, it's because the one who gets the most votes SHOULD win the race. That's the way our elections are supposed to work.

Sad to say, but ALL judges should be unbiased. Unfortunately, most aren't around here. I think anytime a question comes up like this, it should automatically be an unbiased judge appointed to the case. Should be at least 200 miles from the county where the election was held. Maybe that would keep some of this election crime down. By that, I mean these circuit clerks we've had arrested from surrouding areas, etc.

Where is the list of people that were reviewed or were in the wrong? Is there a list available to the public? Can we see those names that are in question? I know one that voted wrong, I just wanted to know if they were caught.

Actually, even if you live in Ntz, you had the right to be notified if an inmate escaped over here. The river isn't a barrier to stop one from going over there. Has anyone ever heard of this judge? Does anyone know anything about his record as a judge. If so, please share.

The following statement made by invidalialouisiana,"I don't blame Lipsey for challenging but it makes me angry that he considers everyone on his list a crook.", is totally uncalled for. Show me some documentation in which Mr. Lipsey states that these people are crooks. I don't believe that anyone has ever heard Mr. Lipsey say that any of these people are crooks. I assume that this list was composed on, all, irregularities that were noticed. Not necessarily fraudulant or illegal actions. I personally applaud Mr. Lipsey in taking a stand this time to make sure everything is on the up and up for the citizens of this parish. I am not into politics but I would like to believe that if I were and had won an election by 21 votes that I would welcome the contest by my opponent to show all of my followers that I had won fair and square.

I would think a prisoner that Randy M. would be holding in his prison wouldn't vote for him if I was the prisoner no way would I vote for him. Lipsey lawyers need to question these guy in private Rangy must have made them some kind of promise they couldn't refuse.

Well the prisoners might be voting for him because he is what they know.
They have no idea how Glenn would handle things and fear of the unkown is a frightening thing.

I would like to see some of this stuff that "individuallouisiana" is saying backed up. It's so easy to say things, but it's harder to follow it up with actual incidents proving that your statements are true. I've been on here everyday reading the comments by everyone, and I haven't seen anything that would lead me to believe that individualouisiana is right. All of the statements I've heard made about Maxwell have been backed up. I REALLY FEEL LIKE CONCORDIA PARISH CAN DO A WHOLE LOT BETTER. By saying this I am not discrediting the good things that Randy Maxwell has done, and I do believe that everyone is human and makes mistakes, but when the amount of mistakes, and the "sweep it under the rug" type activity that goes on sometimes leaves his accountability in a questionable state. Either way, I hope that Lipsey HIMSELF, and Maxwell HIMSELF, even as opponents, are remaining cordial with each other. Being that it is such a small area, at some point they may have to be part of the same team. No matter who wins, a united community is better than a divided community.

And of course, if I were running, I too would contest an election that was won by 22/21 votes.

Let me say that i posted one little comment about the Jena incident and it was not bad at all. Just trying to get that slow site some action, as they had been trying to get us all over there, and they attack you there like ppl would never do here. We are much more civil. I even wound up talking to the person whose post i commented on and they were very nice and wanted to chat with me about the Jena case. End of story.

He then starts listing names. Unlawful refers to being crooked or violating the law. If he wasn't accusing those people of being crooks, he should not have accused them of committing "unlawful activities".

You can be ignorant of the voting requirements and break the law. The law does not forgive ignorance. This list states that "...the following ERRORS and unlawful activities occured." The real errors will have a legitimate explanation therefore no criminal act committed. The list had to be made public for this very reason. This is part of the fact finding mission.

invidalialouisiana sounds alot like randy maxwell to me. I wouldn't be surprised one bit.

I would just like to point out that the names on the list are there for simple reasons. Some are there because of mispelled names, some for old addresses, some for having a maiden name instead of their married name, etc...

The name being there is in no means saying that each one of them are criminals or being accused of anything.

Also, the comments regarding our elderly gender, i do believe, are not correct in assuming that someone couldn't push the button, etc...

I believe "what" they are questioning is did this one have alzheimers, demensia, etc...
Mental disabilities, that sort of thing is probably what they are investigating.

Also, realize that some of these folks had cards mailed in, without the signatures of 2 witnesses and/or a Notary's signature, which is not a legal vote. Anyone could have signed the little old man/ladies name.
I hope this clears some of this up for you guys.

I would also like to say that you need to be careful in assuming who certain people that are posting are pulling for in this election. There are several of Randy Maxwell's employees that are posing as Lipsey "CLAN KLAN CAMP" and trying to humiliate the Lipsey family by saying the offhanded things that they have.

Sometimes I feel that people act so childish, making statements they know nothing about, when it's easier to read and digest the material and then ask questions or make your statements. They just get too excited I guess.

I will tell you this much, I do hope there is a full out investigation on this retired Judge that will be hearing the case. I truly hope that he is an honest man and takes the situation at face value.
The people of Concordia Parish that I have talked to tend to sway heavily towards Lipsey. I've talked to people who've known him for most all of his life and he seems to be an honest hard working man.
I was told that he lost his parents along with one set of grandparents as a child and in my sincerest humble opinion, anyone who can come out of that as such an upstanding citizen has my true admiration. I think it would be a sad thing to see the people waste such a rare quality that he seems to carry.

I also hope that people take to heart that we will face two totally different futures depending the outcome of this ordeal. I'm hoping for truth, for justice, for someone to honor their position as Sheriff of Concordia Parish.
To serve and protect those election signs said, but have we really had that? Sadly, I just don't think so.

The position of Sheriff is not something to be taken for granted. So many people depend on the man wearing that hat.

I just feel that Concordia Parish has been used and abused all the way around.
I'm not saying Randy Maxwell is too bad of a guy, but after everything I've been told in confidence, all the stories that I've read, seeing how his employees act in public and while trying to hide, I just can't see what good he's done.
I guess you just have to spend a little time doing the research to understand where I'm coming from, but I've thought long and hard about this one. I've had about 9 years to get to know them both.
Anyhow, I wish you all a good nights rest and will be saying my prayers, petitioning our God for the right man.

Well I have finally got to read "THE" list! I know several of these people are students in college and military personnel. Not to mention several other legit residents of Concordia Parish. I hope they can back their accusations up if not they could be looking at law suits. As far as the Convicted felons go according to Louisiana RS 18:102 and 18:177, they can vote as long as they are not in jail, on probation or on parole.

I read Randy's statement in the paper. The only "militaryman" on the list is Randy's public information officer's son. Everyone that knows him knows he has a house in baton rouge. I didn't see any military person that lives in concordia serving their country elsewhere on that list. All I have seen and read is Randy trying his case in the media by calling Glenn all sorts of names. No where have I seen Glenn get into the "gutter" with Randy.

I read Andy Magouns statement in the paper that if anyone feels that their name shouldn't be on the list to please contact him with further information. He also said that because of a "time issue" that some names on the list were just questionable for some reason or another. In no way has he or Glenn called anyone crooks. I think you need to go to court and hear the evidence before you cast blame. If the evidence shows that Randy committed wrong doing would you still feel the same?

Did anyone read the petition, did you by any chance notice who it was filled AGAINST? It was filled against the La. Secretary of State, NOT against Randy.
