Charges against Smith dropped

Published Thursday, May 29, 2008

VIDALIA — Charges against one Ferriday man were dropped and a bench warrant was issued for a Ferriday police officer when the officer failed to show up in Seventh District Court Wednesday.

Phil Smith was arrested on charges of interfering with state police and resisting arrest by the Ferriday Police in late February.

Though he was convicted in Ferriday city court on the charge of interfering with a police officer in the performance of his duty, when Smith appealed to district court the additional charges were brought against him, Smith said.

Judge Leo Boothe threw out the charges when, after testimony from witnesses, he concluded there was no evidence Smith resisted arrest or that a state police officer was on the scene.

Boothe also issued a bench warrant for Ferriday police officer Derrick Freeman because he failed to appear in court after being subpoenaed.

Smith was arrested after his wife Lisa Smith, who he was with, allegedly interrupted Freeman, who was issuing a traffic ticket nearby, to reportedly inform him of a drug dealer in the area.

Lisa Smith faces similar charges, but her case is being treated as a separate matter, Phil Smith said.

For once Leo Boothe got something right! The charges leveled against Phil and Lisa were ludicrous to begin with! The Freeman said that Phil interrupted the duties of a "State Police Officer"! Freeman is a FPD officer!

Hopefully when Lisa goes to court something similar will happen and her charges will be dropped too!

Congrats Phil! Good luck Lisa!

Boy that sounds stupid on the officers behalf.I would think drugs that kill children and adults should be addressed right away.Somethings does not get done right in our legal system. It is going to the dogs.I mean it is messed up bad.

No vernon. That speed trap in Ferriday is much more important in maintaining than worrying about some harmless drug dealers who fry kids' brains. Where are your priorities at? ;)

Once again, Ferriday is a joke. And they wonder why people don't want to send their children to school there or open a new business there. As Bill Engvall says, Here's your sign.

It's obvious Ferriday allows for the sale and use of illegal drugs...however, they DO NOT stand for misdemeanor offenses! Yep, you can sling your dope to children, smoke it on the street corners, beat up your grandmama, etc.....but DO NOT EVEN THINK ABOUT giving a cop a tip about criminal behavior. How's that for fighting the drug war? Something tells me the dealer Mr. Smith was telling the cop about was a buddy or "fellow slinger".
