Grand jury indicts Waterproof mayor on 44 charges

ST. JOSEPH — A Tensas Parish grand jury handed down indictments against the mayor and police chief of Waterproof this week.

The indictments against Mayor Bobby Higginbotham and Police Chief Miles Jenkins were filed Thursday.

Higginbotham faces 44 total charges, including 18 counts of malfeasance in office, 21 counts of felony theft, one count of unauthorized use of a moveable and four counts of public salary deduction.

Jenkins faces three counts of malfeasance in office.

The malfeasance allegations against Higginbotham include claims that he told Waterproof employees to purchase goods from a business he or immediate family members had a significant stake in and that he used more than $3,000 in town funds for trips to Los Angeles, Las Vegas, Chicago, and San Francisco.

He is also accused of improperly converting, depositing and using more than $32,000 from the town’s Meter Deposit Fund.

A number of the malfeasance charges allege he improperly handled traffic tickets, failed to conduct a state-mandated town court and paid illegal bonuses to police officers for exceeding illegal ticket quotas.

Higginbotham also allegedly used the town payroll system to collect personal loans made to town employees, and is accused of using town equipment to maintain private property.

The felony theft charges stem from allegations that he fraudulently increased his salary without approval of the town’s aldermen, collecting an additional $36,500 between July 2007 and February 2009.

One of the counts of malfeasance against Jenkins alleges that he illegally reduced citations, something the police chief does not have the power to do.

The other two counts of malfeasance include a charge that he accepted illegal bonuses.

This sounds like a story out of HIcktown, 1955, where the po-leece chief runs the town, making up his own laws as he sees fit. An Orson Welles film comes to mind..."Touch of Evil".

Its so great to see them circling the drain finally. No big surprise he & his "chief" proclaim their innocence b/c the "whites" are out to get them!! Hopefully with This many counts against them, it will be next to impossible for either to worm their crooked selves out. He should know a Mayor nor his Chief are above the law. Hey it can't be just the whites -- the town has basically gone black.

This was a wonderful community when I was a child and I had friends and relatives who lived there.

I have heard so many things about Bobby and his "businesses" and his "residences". Way to go! Lookout others --- the citizens are getting tired of being fleeced.

Let's not make color an issue,its just people in general especially law officers. They are supposed to uphold the law,but here in central louisiana they create their own laws. Here you are guilty until proven innocent...Lets follow this and see what really happens..when law officers get in trouble the bark is always worse than the bite. They will probably get a slap on the wrist.

Malfeasance in Office dwells in a broad spectrum of violations. They couldn't really find any one particular thing, so that charge was all they could come up with. I know Chief Jenkins. Go to the same church with him. He was just following orders from his boss as far as the tickets are concerned. How can any one entity say that he does not have the right to "Fix" tickets when every police department in America does it. It's unfair to charge him with that when he was called by some "Higher Ups" and asked to give certain people close to them a break on their tickets. I need not mention names because they know who they are. The mayor gave the Chief bonuses because his ticket issuance brought in revenue for the town. Doesn't every ploice department in America have a certain number of citations that must be issued in a given day, week, month, year perhaps? If not, then someone will say the police officer is not doing his job. Why penalize a man for doing his job that he was hired to do. The State Police has a quota that needs to be met. I don't hear anyone saying anything about that. Many police chiefs,sheriffs and mayors get tickets cleared and tossed for certain individuals. Why not charge police officials all across the State of Louisiana because they all do it? The wonderful town council of Waterproof just recently tried to get the Mayor recalled. They had well over 500 required signatures. They presented the information to the U.S. Attorneys office, but they made a fatal mistake. They had signatures of people that did not live in Waterproof, so-called signatures of the deceased, and also signatures of people from the voters registration polling sheets that had moved from Waterproof many years ago. Did they think that this list was not going to authenticated? Of course they did. That's because they are being used by "Higher Ups" in Tensas Parish to do their dirty work. Their plan did not work, so they set another in motion. The "Wonderful" town council decided not to pass a budget a few months ago thereby causing the bills for the town to go unpaid. Now who are the real criminals here?

I say once again that this is a political witch hunt due to the fact that the town of Waterproof wants Higginbotham out and Chief Jenkins' name and reputation has to be tarnished because he works directly for and with the man.If people were not out breaking the traffic laws, Chief Jenkins would not have the chance to write citations. Then his boss, and the wonderful town council, would want to know what is he doing for 5-8 hours each day.

My advice to Chief Jenkins is to resign this position, get the heck out of Waterproof.Your services are not need and was never appreciated. It is a shame the good has to suffer for the bad, and that many times we are wrongfully convicted by association.

Chief Jenkins bent a womans fingers backwards while he had her pulled over and he was arrested and when he was arrested the sheriffs office said they had numerous complaints on him about his nasty attitude. Chief Jenkins threw a pregant woman to the ground. The town of Waterproof makes most of it's revenue from tickets the police sits out there on hwy-65 why the town its self has a noise oranidance against boom boxes they play them so loud it will rattle you out your home, people speed in TOWN, urinate out in the public, walk in the middle of the streets you have to drive around them, while the P.D has a person pulled for driving 5 m.p.h over the speed limit on the hwy. Higginbotham made a good run when he first took over as the mayor in cleaning up the town I was impressed when I heard he was going around town and giving the drunks trash bags to pick up thier beer cans out of the ditches. I still wonder today what happened to the 20 thousand plus dollars the town recived through a federal grant to build a new fire station although this did happen before Higginbotham became mayor the town still houses it's fire trucks or shall I say the parish fire districts trucks in 15x40 jail cells built into the town hall. It is more to Waterproofs problems than Higginbotham and Jenkins it started a long long time ago.

Chief Jenkins did not bend a womans finger back. Chief Jenkins was defending himself when this woman pointed her finger in Chief Jenkins' face and poked him in the face for giving her a ticket. He simply grabbed her hand knocking it from his face. This woman happens to be a relative of the D.A. of Tensas Parish and she felt that her political connection should make her above the law. Neither did Chief Jenkins throw a pregnant woman to the ground. The so-called pregnant woman made a wrong turn by backing up on a busy highyway nearly causing a major accident. This woman then started cussing and became very beligerent and threatening with the Chief. Do you have the facts? I do!

If you see all these things happening why don't you report them instead of turning your head. On any street in America, there is a speed sign posted. The speed is as it states. There is no law anywhere that says a person is allowed to drive 5 miles over the posted speed limit. Police officers allow it sometimes, but the law is the law. The complaints against Chief Jenkins are made because he will not tolerate people being verbally and sometimes physically abusive towards him. Many times he could have arrested those who made threats on him. Many times he has given people breaks by just writing citations when he could have had their cars impounded.

People say he has a nasty attitude, yet they fail to mention that his nastiness was provoked by their own actions against him. Call a spade a spade if you will. But let the real truth be told here. The mayor will have to answer to all allegations against him and so will the Chief. I just feel that Mr. Jenkins is getting a raw deal. Bad attitude or not!

You need to get your facts straight and quit defending Mr. "Jap" Jenkins. I know alot more than you think I do and why are you only defending him and not Higginbotham. Mr Jenkins left his little roadside parking area and almost struck another car with lights and sirens just to write a ticket to an elderly man.

Lily Dream if Mr. Jenkins is faithful as you are saying why did he not resign from the P.D when Bobby wanted him involved in the corruption like giving him access to the town gereral fund acounts to pay bills and such why Mr. Bobby was running from the law. Mr. Jenkins was sworn in to protect the very same laws he has broken. Jenkins faces three counts of malfeasance in office do you think Bobby held his hand and make him do the things he did no man will make me do something that I don't want to a faithful man as you say he is would not do the things he did.

People do what they want in Waterproof. Always have. We need some real police. This is the only place you can drive and see idiots walking in the middle of the street, on the yellow stripe- practically daring cars to hit them. You don't even see that in St. Joe, or Ferriday. I know we don't have side walks, but, at least walk on the side of the road, not down the middle.

Yeah Waterproof has sidewalks but you can't access them now because they are either busted up,grown up with tangle vines. Oh you are talking about Fifth st. where there is not any sidewalks the trouble where they do walk in the center stripe the town aldermen has been fighting with the mayor since he took office he wants them to approve a budget for the year and they can't even see the funds the town has to approve one If all goes well I hope Mr. Flood takes the reins and steers the town back in the right direction.

The newsstar.com is reporting today Feb. 19 that the mayor and chief has been arrested by the state police also reports they bonded out.
