High court reversing Lowndes decision
Published Saturday, July 4, 2009
JACKSON (AP) — The Mississippi Supreme Court has reversed two rulings in a life insurance dispute from Lowndes County.
The justices on Thursday said Daniel Ray Weathers can pursue his claims of fraud against Metropolitan Life Insurance Co.
Circuit Judge Lee Howard in 2007 dismissed Weathers’ lawsuit — a decision that was upheld by the Court of Appeals in 2008. However, the Supreme Court overturned those decisions and sent the case back for a trial in Lowndes County.
The Supreme Court threw out the lower courts rulings’ that Weathers had waited too long to file his lawsuit in 2001. His suit alleges MetLife fraudulently concealed information about a ‘‘vanishing premium’’ provision in a policy sold to him in 1994.
