Court hears Havard case Monday

Natchez &8212; The Mississippi Supreme Court will hear oral arguments Monday in the death sentence appeal of Jeffery Keith Havard.

Havard was convicted and given the death penalty in 2002 for the murder of 6-month-old Chloe Madison Britt in Adams County.

This step in the appeal process is typical procedure for any death penalty case, District Attorney Ronnie Harper has said.

Harper and attorneys from the local office will not be a part of the arguments, but will be on hand to answer any questions the justices may have. State Attorney General Jim Hood, Marvin L. White and Melanie Kathryn Dotson will handle the case for the state.

Havard&8217;s attorneys are Andre De Gruy and Stacy P. Ferraro.

Attorneys from both sides will have the opportunity to present arguments Monday, but they won&8217;t call witnesses like in a trial.

Chloe Madison Britt was the daughter of Rebecca J. Britt of Ferriday. Rebecca Britt and Havard were living together on Montgomery Road at the time of the child&8217;s death.

During the trial prosecutors argued that Chloe&8217;s injuries were caused by shaken baby syndrome, but also said she had been sexually abused.

Rebecca Britt was out of the house on the night of her daughter&8217;s death, but returned to find her not breathing. She took the baby to Natchez Community Hospital, where she was pronounced dead.

The proceedings start at 9:30 a.m. Monday in Jackson before the full court.
