Wrongful death suit settled

NATCHEZ — The wrongful death suit against the husband of the late Dr. Lynn Palmer has been settled.
Palmer’s family, filed the suit against Dr. Marshal Hawkins in August 2008, alleging he poisoned Palmer.
Palmer died in a Jackson hospital in July 2007, and at the time of her death the cause was reported as bacterial septicemia.
“Some parts of the case were resolved to the satisfaction of everybody, but I cannot discuss (the resolution) because there is a confidentiality agreement,” said Carlton Reeves, the attorney who represented Palmer’s family.
Reeves said the case against Hawkins was dismissed following the settlement.
In an amended legal complaint filed by Lois, Palmer, Leland Palmer, Howard Palmer and Hawkins Tuesday against New York Life Insurance Company, the statement of fact states the claims against Hawkins have been resolved and dismissed.
The complaint states in addition to the $1 million life insurance policy that Palmer had with the company, New York Life owes an additional $500,000 because her death was accidental, a provision of the policy. It also states Hawkins has assigned a portion of the payable benefits for the accidental provision to the family.
The complaint referred to Palmer as “the decedent,” and states that she, “raised, managed and milked goats. The goats were rambunctious and difficult to handle.”
It states that Palmer routinely suffered cuts on her hands and arms from caring for the goats.
The complaint goes on to say, “The goats were also infected with Streptococcus B agalactiae, which is the bacteria which caused (Palmer’s) death. (Palmer) contracted the bacteria through an accidental cut on her hand and/or arms from the goats or from drinking unpasteurized goat’s milk, as she often did.”
The complaint states that Palmer died within 180 days of contracting the bacteria.
The filing requests a trial by jury.
