Parish agencies file lawsuit

VIDALIA — Nearly every government entity in Concordia Parish has filed suit against Louisiana Machinery Rentals, LLC and Louisiana Machinery Company, LLC for sales tax dollars totaling approximately $626,546.

The Concordia Parish School Board, the Concordia Parish Hospital District 1, the Concordia Parish Police Jury, the City of Vidalia and the Town of Ferriday are all filing against the company.

The suits allege the company failed to pay sales and use taxes for the period including Dec. 1, 2000, through June 30, 2007.

Concordia Parish Tax Collector Randy Temple said nothing is certain on the suits yet.

“Right now we have just filed suit,” he said. “It is in the hands of the attorneys and court system now.”

The company is domiciled in St. John the Baptist Parish.

While the company does not have a physical business in the parish, Temple said tax is still drawn for work they do in the parish.

“People do business in the parish, and they are not based in the parish,” he said.

Concordia Parish School Board Business Manager Tom O’Neal said the only thing going on right now is that suits have been filed.

“It may work out to where they don’t owe us anything,” he said.

O’Neal said the suits were filed after the organizations assessed Louisiana Machinery’s taxes.

“There is an assessment we do on taxes, and they didn’t have enough for us to assess them properly,” he said. “We do audits, and they are required by law to have them.”

Louisiana Machinery Company, LLC is reported as owing the school board $188,673.51, the hospital district, $43,981.50, the police jury $102,176.82, the City of Vidalia $920.55 and the Town of Ferriday $2,322.

Louisiana Machinery Rentals, LLC is reported as owing the school board $174,834.24, the hospital district $21,854.28, the police jury $85,355.67, the City of Vidalia $2,790.71 and the Town of Ferriday $3,637.28.

President of human resources for Louisiana Machinery Company, LLC Jim Miller declined to comment on the issue.
